A glimpse into Orvallian government, from the City Council Meeting June 12, 2008. We heard that Mayor Nelson, was to unlawfully try and remove Julie Wilson from her appointed council position with the help of course of our illustrative City Attorney, Rich Rodeman. Julie Wilson had been impersonally notified by a message on her answering machine, by a temporary City employee, that her appointment had been voided on May 9th. One of the posted agenda items for the June 12, City Council Meeting was: Old Business Vacant Council Position. Knowing this and being unable to have the Mayor cease his actions, Ms. Wilson, was forced to hire a local attorney, Roger Gould to represent her. Attorney Gould sent the council a letter, advising that Julie Wilson's appointment was lawful, citing Oregon Supreme Court case law from a similar case in Toledo Oregon and pointed out many other flawed conclusions by the City Attorney. Further, that if they tried to unlawfully remove Julie, the City, Mayor Nelson and any Council member voting to remove her would be sued. Mayor Nelson was asked by members of the audience to drop his attempt to remove Julie Wilson from the council, and spare the city a lawsuit, which he refused to do, saying only that he wants the City Attorney to review Attorney Roger Goulds Letter; they then moved to table it until June 24th in Executive Session (negating any public comment). The mayor's actions of requesting a legal opinion from City Attorney Rich Rodemman, citing grounds to remove and invalidate Ms. Wilson's appointment, stated in part the following instructions to the mayor: At the next council meeting, the Council must "fix" this situation. (a) The Mayor should place the issue of "council vacancy" on the next agenda as "Old Business" (b) The City Recorder should report the City Attorney's conclusion that the person selected on May 8th, "Julie" was not lawfully appointed to the Council. (c) The council should move to RESCIND the appointment of "Julie" to the council So far, the running tab from attorney Rodeman (who has a history of giving bad legal advice to the City Council) has charged the city $400, to justify removing Ms Wilson. To review Attorney Roger Gould's (3) page letter, will undoubtedly cost the city another $1000. What a colossal waste of city funds, not to mention the hurt and finical burden, he has put on Julie Wilson. This City Attorney has cost the city ten's of thousands of dollars in city funds, on what many think are defective legal opinions, from his offices in Corvallis. I understand he has recanted his opinion concerning Julie Wilson, saying that he instructed the Mayor and Council to Rescind Julie's appointment. Not sure how he can deny it, as he put his instructions to the Mayor and Council in letter form. In my opinion he should have his services terminated immediately. - The Sentinel
